  1. Upon submission to the Texas Center for Educational Technology ("TCET") for use as an Assessment Instrument as part of TCET's INSIGHT Instrument Library, there will be no change in the intellectual property ownership of the Assessment Instrument. Instrument Creators and any other appropriate parties will be credited with authorship of their respective Assessment Instrument(s). However, any individual who submits an Assessment Instrument ("Submitters") based on others' intellectual property must obtain permission to do so from the rightful owners of such intellectual property. Submitters must also obtain permission to submit the Assessment Instruments from any other party who may have an ownership interest in the Assessment Instrument. Submitters warrant and represent that they shall indemnify and hold harmless TCET for any and all third party actions regarding a submitted Assessment Instrument, including, but not limited to, attorneys fees and court costs.
  2. In conjunction with the submission of an Assessment Instrument, to the extent necessary, Submitters agree that they have either obtained or are providing TCET with any necessary license in order for TCET to, in its discretion, administer the submitted Assessment Instrument.
  3. TCET reserves the right to modify these terms upon thirty days written notice. Notwithstanding anything to the contrary, TCET reserves the right to modify these terms immediately if circumstances arise that require prompt action. TCET also reserves the right to institute administrative procedures as necessary to enforce these terms.
